1. Introduction

These Terms of Service ("Terms") govern your use of Bloomspace ("the Application," "the Service"), an AI-powered garden and landscape design transformation application provided by After9Labs ("we," "our," or "us").

By accessing or using Bloomspace, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. What You Should Know at a Glance

• The Service is intended for personal, non-commercial use by consumers
• Users must be at least 13 years old to use Bloomspace
• Some features require a paid subscription
• You retain ownership of your uploaded garden photos
• Our AI features process your images to provide garden transformation and design services

3. Account Registration

To use certain features of Bloomspace, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials confidential and secure
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

Account Restrictions:

• Accounts registered by bots or automated methods are not permitted
• Each user must register only one account unless explicitly permitted
• User accounts may not be shared with other persons

4. Account Termination

Termination by You: You can terminate your account at any time by using the account deletion tools within the Application or by contacting us directly.

Termination by Us: We reserve the right to suspend or delete accounts that we deem inappropriate, offensive, or in violation of these Terms, at our sole discretion and without prior notice.

The suspension or deletion of accounts shall not entitle users to any claims for compensation, damages, or reimbursement.

5. Service Description

Bloomspace provides the following features:

• AI Garden Transformation: Upload photos of your garden and see AI-generated design transformations
• Style-Based Design: Choose from various garden styles adapted to your climate and budget
• Multi-Step Planning: Get dream, realistic, and phased transformation plans
• Plant Intelligence: Receive climate-compatible plant recommendations with maintenance info
• Design Breakdowns: View detailed zone analysis, material lists, and cost estimates
• Seasonal Previews: See how your garden will look across different seasons
• Growth Projections: Visualize your garden over time (Year 1, 3, 5)

6. User Content

6.1 Your Content

You retain ownership of all content you upload to Bloomspace, including photos, images, and garden data ("User Content"). By uploading User Content, you confirm that:

• You have the legal right to upload and share such content
• Your content does not infringe any third-party rights
• Your content complies with applicable laws and these Terms

6.2 License Grant

By uploading User Content, you grant us a non-exclusive, royalty-free license to process such content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.

6.3 Prohibited Content

You may not upload content that:

• Contains nudity, sexually explicit, or pornographic material
• Depicts minors in any inappropriate context
• Is illegal, harmful, threatening, abusive, or harassing
• Infringes intellectual property rights of others
• Contains malware, viruses, or harmful code
• Violates any person's privacy rights

We reserve the right to remove any content that violates these Terms without prior notice.

7. AI Features and Generated Content

Our AI-powered features, including the garden transformer and design generator:

• Process your uploaded garden images using artificial intelligence technology
• Generate virtual representations that may not be perfectly accurate
• Are provided for personal use and visualization purposes only
• Should not be used to create misleading, deceptive, or harmful content
• May have usage limits based on your subscription tier

Important: AI-generated garden designs are approximations and should be verified with local landscaping professionals before implementation. Plant recommendations are suggestions and may vary based on specific local conditions.

8. Acceptable Use

You agree to use Bloomspace only for lawful purposes and in accordance with these Terms. You shall not:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for any commercial purpose without authorization
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems or bots to access the Service
• Circumvent any usage limits or restrictions

9. Paid Services and Subscriptions

9.1 Pricing

Some features of Bloomspace require payment. Prices are displayed within the Application and include all applicable fees and taxes. Prices are subject to change with notice.

9.2 Subscriptions

Subscriptions automatically renew unless cancelled before the current period expires. To maintain your subscription, you must pay the required recurring fee in a timely manner.

9.3 App Store Purchases

Purchases made through the Apple App Store or Google Play Store are subject to the respective store's terms and conditions. For subscriptions via Apple:

• Payment will be charged to your Apple Account
• Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends
• Manage or cancel subscriptions in your Apple App Store account settings

9.4 Trial Period

We may offer trial periods for certain features. Trial periods automatically convert to paid subscriptions unless cancelled before expiration.

9.5 Refunds

Refund policies are governed by the platform through which you made the purchase (Apple App Store, Google Play Store). Please refer to their respective refund policies.

10. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, design, graphics, and AI models, are owned by After9Labs or its licensors. You may not:

• Copy, modify, or distribute our proprietary content
• Use our trademarks without permission
• Access or attempt to access our source code
• Create derivative works based on the Service

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES OF NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
• WARRANTIES REGARDING AI-GENERATED CONTENT ACCURACY

AI-generated garden designs are approximations and may not accurately represent actual implementation results. Plant recommendations should be verified with local nurseries or landscaping professionals.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTER9LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Unauthorized access to your data
• Errors or inaccuracies in AI-generated content
• Any third-party conduct on the Service
• Costs incurred from implementing AI-suggested garden designs

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold After9Labs and its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

14. Changes to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice. We may also update these Terms from time to time. Material changes will be communicated through the Application or via email. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiations first. If negotiations fail, disputes shall be submitted to the competent courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
